Echo User Service Agreement

1. Introduction

Welcome to Echo (“Echo”, “we”, “us”, or “our”). This User Service Agreement (“Agreement”) governs your access to and use of the Echo mobile application, website, and related services (collectively, the “Services”).

By downloading, installing, registering for, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement and our Privacy Policy.

If you do not agree to any provision of this Agreement, please discontinue use of the Services immediately.

2. Eligibility

You must be at least 18 years old or have reached the age of majority under applicable law to use the Services.

By using the Services, you represent and warrant that:

• You meet the applicable age requirements;

• You have the legal capacity to enter into this Agreement;

• All information you provide is truthful, accurate, and complete.

3. Account Registration

3.1 Supported Login Methods

You may register and log in using Apple Sign In or other login methods that we may support from time to time.

3.2 Account Security

You are solely responsible for maintaining the confidentiality and security of your account.

You shall be responsible for all activities conducted through your account.

3.3 Account Suspension

We reserve the right to suspend, restrict, or terminate any account that:

• Violates this Agreement;

• Engages in fraudulent activities;

• Harms the interests of other users or the platform;

• Violates applicable laws or regulations.

4. Location Check-in Services

4.1 Service Description

Echo provides location-based attraction check-in services that allow users to record visits to attractions, landmarks, and points of interest.

4.2 Location Verification

To complete a check-in, the application may request access to your device location when you actively initiate a check-in request.

Location information is used solely to verify whether you are physically present within the permitted check-in area.

4.3 No Continuous Tracking

Echo does not continuously track user movements.

Echo does not provide:

• Background location tracking;

• Route recording;

• Navigation services;

• Real-time location sharing;

• Geofencing monitoring.

4.4 Check-in Accuracy

GPS positioning, network positioning, and map services may be affected by environmental conditions, device hardware, signal quality, or third-party service providers.

Therefore, we do not guarantee the absolute accuracy of check-in verification results.

5. User Content

5.1 User Content Ownership

Users retain ownership of all content they upload, publish, or submit through the Services, including but not limited to:

• Photos;

• Comments;

• Ratings;

• Check-in notes;

• Other user-generated content (“UGC”).

5.2 License Grant

By uploading content, you grant Echo a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute such content solely for operating and improving the Services.

5.3 Content Moderation

To maintain a safe community environment, user content may be reviewed through automated systems and/or manual moderation before publication.

We reserve the right to remove, restrict, reject, or disable access to content that violates this Agreement.

5.4 User Reporting Mechanism

Users may report content, accounts, comments, or activities that violate applicable laws or this Agreement through the in-app reporting tools.

Reported content may be reviewed and removed where appropriate.

5.5 Prohibited Content

Users shall not upload, publish, or distribute content that:

• Contains pornography, nudity, or sexually explicit material;

• Promotes violence, hate speech, discrimination, or harassment;

• Violates intellectual property rights;

• Contains private information of third parties;

• Contains unauthorized photographs of private residences or private locations;

• Violates any applicable law.

6. Anti-Fraud and Check-in Integrity

To maintain fairness and authenticity, users shall not:

• Use GPS spoofing tools;

• Use virtual location software;

• Manipulate device location services;

• Circumvent check-in verification mechanisms;

• Create fake check-ins;

• Use automated tools, scripts, or bots.

Where fraudulent behavior is detected, Echo may:

• Cancel check-in records;

• Restrict account functions;

• Suspend or terminate accounts;

• Take additional actions permitted by law.

7. Privacy and Data Protection

Your privacy is important to us.

Our collection, use, storage, and protection of personal information are governed by our Privacy Policy, which forms an integral part of this Agreement.

By using the Services, you agree to the Privacy Policy.

8. Intellectual Property

All rights, title, and interest in the Services, including software, trademarks, logos, graphics, designs, databases, and source code, remain the exclusive property of Echo or its licensors.

No part of the Services may be copied, reproduced, modified, distributed, or commercially exploited without prior written authorization.

9. Disclaimer

The Services are provided on an “AS IS” and “AS AVAILABLE” basis.

To the maximum extent permitted by law, Echo disclaims all warranties, whether express or implied.

We do not guarantee:

• Uninterrupted operation;

• Error-free services;

• Permanent availability of any feature;

• Absolute positioning accuracy;

• Continuous compatibility with all devices.

Map data, positioning data, and attraction information may originate from third-party service providers. We do not guarantee their completeness, timeliness, or accuracy.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Echo shall not be liable for:

• Indirect damages;

• Consequential damages;

• Loss of profits;

• Loss of data;

• Business interruption;

• Losses resulting from inaccurate location information;

• User-generated content;

• Third-party services or websites.

11. Account Deletion

Users may request account deletion through:

Settings → Account & Security → Delete Account

Upon successful deletion:

• Personal information will be deleted or anonymized;

• Check-in records may be deleted or anonymized;

• User-generated content may be removed;

• The account cannot be restored.

Deletion requests are generally processed within 7 business days unless a longer period is required by applicable law.

12. Service Changes and Termination

We may modify, suspend, discontinue, or update any part of the Services at any time.

Where reasonably practicable, we will provide advance notice through in-app announcements or other appropriate means.

13. Governing Law

This Agreement shall be governed by and interpreted in accordance with applicable laws of the jurisdiction where the Service operator is registered, unless otherwise required by mandatory local law.
